Terms of Service

These Terms of Service ("Terms") govern access to and use of the website at bjjahanianbook.com and the professional services provided by Monroe & Ashcraft Rare Books, a sole-proprietorship registered in San Diego County, California, operated by William Monroe (the "Studio", "we", "our"). By using the Site or engaging the Studio you agree to these Terms.

1. Use of the Site

You may browse the Site for personal, non-commercial purposes. You may not scrape, copy in bulk, or republish content without written permission. Descriptions of books on the Site are prepared in good faith but availability, condition, and price may change without notice; nothing on the Site constitutes an offer capable of acceptance until confirmed in writing.

2. Engagements & scope

Each professional engagement (sourcing, appraisal, curation, estate consultation) is confirmed by a written scope-of-work signed by both parties. The scope will set out deliverables, price or hourly rate, payment terms, and the estimated timeline. In the absence of a signed scope, informal correspondence does not create a contractual obligation on either side.

3. Payment & invoicing

Invoices are due 14 days from the invoice date unless otherwise stated. We accept bank transfer, check, and card payment through Stripe. A 1.5% monthly late fee (18% APR) may be applied to balances more than 30 days overdue, subject to California law.

4. Book sales

Books are sold with a written description and condition report. If a book is found not to match its description within 14 days of receipt, we accept its return in the condition supplied and refund the purchase price in full. Shipping is at cost, fully insured; risk passes on delivery.

5. Appraisals

Written appraisals reflect our professional opinion of fair market value as of the effective date of the report, prepared in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP). We do not guarantee that a book will realise the appraised value at any subsequent sale. Appraisal fees are earned regardless of the value determined; we do not accept percentage-of-value compensation for appraisal work.

6. Confidentiality

We treat client engagements as confidential. We will not disclose the existence of an engagement, the contents of a client's library, or the results of an appraisal to any third party except (a) with your written consent, (b) to professional advisers under confidentiality, or (c) as required by law.

7. Intellectual property

All original content on this Site — including the wordmark "Monroe & Ashcraft", the logo, photography, and written text — is the property of the Studio. Book descriptions may be excerpted (up to 100 words) with attribution and a link back to the source page.

8. Limitation of liability

To the fullest extent permitted by California law, our aggregate liability arising out of or in connection with any engagement or use of the Site is limited to the fees paid by you to the Studio in the twelve months preceding the claim. We are not liable for indirect, consequential, or incidental damages.

9. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that cannot be resolved through direct discussion will be submitted to non-binding mediation in San Diego County before either party commences litigation.
